Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by PenPos (“we,” “us,” or “our”), including our website and related applications (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1. Scope

These Terms apply to all interactions between us and any individual using the Services (the “User”).

2. Service Overview

We provide application support services for the lump-sum withdrawal of Japan’s Employees’ Pension and the associated income tax refund on behalf of eligible former residents.

3. Eligibility & User Obligations

  • Submit accurate and complete documents by the deadlines we specify.
  • Guarantee the truth and accuracy of information you provide.
  • Our Services assume the User currently resides outside Japan.

4. Fees & Payment

  • The Services are provided on a success-fee basis. Fees are charged only when a refund is paid.
  • The fee is the greater of 10% of the pension lump-sum amount or JPY 20,000, typically deducted from the tax refund amount.
  • Payment method and timing follow our instructions.
  • If no refund is paid, no fee is due.

5. Prohibited Conduct

  • Submitting false information or documents
  • Unauthorized resale or reuse of our materials
  • Infringing on our or third parties’ rights
  • Activities that violate laws or public order

6. Disclaimers

  • Outcomes depend on government bodies. Refund amounts and processing times are not guaranteed.
  • We are not liable for losses caused by user delays, inaccuracies, or omissions.

7. Personal Data

We use personal information for the following purposes and manage it appropriately:

  • Providing Services (pension/tax procedures)
  • Identity verification, status updates, and fee invoicing
  • Submissions to authorities where required (e.g., pension agency, tax office)

We enforce strict data protection measures, including with trusted contractors. We respond promptly to requests for access, correction, or deletion.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction.
